Eviction notice rules in Wyoming

Nonpayment notice

3-day notice to quit โ€” one notice covers nonpayment and any other ground; Wyoming has no separate pay-or-quit track (W.S. ยงยง1-21-1002, 1-21-1003). Paying rent in full before filing MAY (not guaranteed) prevent the action.

Lease-violation notice

Unconditional quit (no second chance)

How the notice must be served

In person, left at the tenant's residence, or left at their workplace if they cannot be found (W.S. ยง1-21-1003). Taping the notice to the door is valid, but courts expect a good-faith attempt at personal service before posting. The notice need not be handed to the tenant personally to be valid.

Your right to fix it (cure)

No statutory cure right. The tenant's only reliable protection is to leave or to defend in court; paying rent in full before filing is not a guaranteed solution.

How days are counted

Day-counting rules (weekends/holidays; when the clock starts) <em>reported โ€” confirm with a licensed attorney</em>.

After the notice expires

Landlord must file a forcible entry and detainer action in circuit court. The tenant does NOT have to leave within the 3 days โ€” only a court-issued writ of restitution can remove the tenant, and the sheriff carries out the removal (within 2 days of receiving the writ).

Court timeline

Summons served 3-12 days before trial (W.S. ยง1-21-1004); writ of restitution on judgment; sheriff removes the tenant within 2 days of receiving the writ. Roughly 2-4 weeks total.

No statewide anti-retaliation statute found โ€” unverified, needs attorney review; FHA discrimination defense applies.

The one thing to remember: in Wyoming, as in every state, a notice is not an eviction. Your landlord must file a case, serve you properly, and win before a judge. Only a court order can remove you.
