Eviction notice rules in Oklahoma

Nonpayment notice

5-day written demand for payment (41 O.S. ยง 131(B)). Demand for past-due rent is deemed a demand for possession โ€” no further notice to quit is required for this ground. The notice may be given before OR after the landlord files the eviction action.

Lease-violation notice

15-day written notice to cure or quit for lease violations; tenant has 10 days to remedy the breach, and the lease terminates on a date not less than 15 days after receipt if not cured (41 O.S. ยง 132(B)). Immediate notice to cure/vacate allowed for conduct threatening health and safety (41 O.S. ยง 132(D)).

Unconditional quit (no second chance)

No formal unconditional-quit track identified in statute; health/safety threats allow immediate cure-or-vacate notice (ยง 132(D)).

No-cause / end-of-tenancy notice

Month-to-month: 30 days (41 O.S. ยง 111). Tenancy of less than a month: 7 days. A fixed-term lease expires by its terms with no notice needed; landlord may sue immediately if tenant holds over.

How the notice must be served

Personal delivery to the tenant first; if unavailable, delivery to a family member over age 12 residing with the tenant; if neither is possible, post in a conspicuous place on the unit AND mail a copy by certified mail. Mailed notice extends the notice period by 3 calendar days.

Your right to fix it (cure)

Nonpayment: pay within 5 days to stay. Lease violations: 10 days to remedy the breach within the 15-day notice window; repeat violations after cure may be treated as non-curable.
